Bills for percentage rate tenders will be prepared at estimated rates, with the percentage excess or less added/subtracted from the gross amount.
Compensation for delay is 1.5% per month of the tendered value, not exceeding 10% of the tendered value.
In case of rescission of contract, 20% of the value of left-over work will be realized from the contractor as penalty.

Security & deductions from the DTCN (15)

Contractors proposing to engage machinery deployed outside the State must furnish an additional 1% EMD/Bid Security.
Engineer Contractors desirous of EMD exemption must submit an affidavit stating they have not availed the facility for more than two works (excluding this one) during the current financial year, mentioning the works and authorities.
EMD is 1% of the estimated cost, or 2% if deploying machineries from outside the State.
The successful bidder must furnish a performance security (Initial Security Deposit) of 2% of the tendered amount and sign the agreement within 15 days of the notification of award.
The security deposit, including earnest money, will be retained as security and refunded after 12 months of completion of work and final bill payment, without interest.
EMD will be forfeited if tenderers back out from the offer before acceptance.
The cost of empty cement bags (Rs. 4.00 per bag) will be deducted from the bill.
1.00% of the gross amount of the bill will be deducted towards income tax.
18% GST (9% OGST + 9% CGST) will be added to the agreement value, and 2% of the gross amount will be deducted towards sales GST for agreement values of Rs. 2,50,000 and above.
Additional Performance Security (APS) is not required for bids below 0% but not below 10%.
If the bid price is between 10% and 20% below the estimated cost, APS increases by 0.2% for each percentage below 10%.
If the bid price is between 20% and 30% below the estimated cost, APS increases by 0.3% for each percentage below 20%, in addition to 2% of the accepted bid price.
If the bid price is below 30%, APS increases by 0.5% for every percentage below 30%, in addition to 5% of the accepted bid price.
1% of the gross amount of the bill will be deducted towards Cess as per the Building & Other Construction Workers (RE & CS) Act.1996 & Building & Other Construction Worker Welfare Cess Act.1996.
If the 1st lowest or subsequent lowest tenderers withdraw, they will be penalized with forfeiture of EMD and potential blacklisting.
