Upon acceptance of the tender, the successful tenderer shall within 10 days deposit an initial security sum to make 2% of the work as per the accepted tender and sign the agreement in PWD form-2
All rates and prices in the tender shall cover Cess, ferry, tollages charges, Royalties, other charges but without GST
The work will have to be completed within the stipulated period as mentioned in the NIT

The Chief Engineer, (Buildings & Bridges), Rural Works Odisha / Chief Construction Engineer, R.W. Circle, Berhampur, reserves the right to reject any or all tenders without assigning any reason
No tender shall be finally accepted until the required amount of Initial security money is deposited
In case of any discrepancy between words and figures, the words shall prevail, and between unit rate and total, the unit rate shall prevail

In the event of any delay due to the Department in the supply of departmental materials or detailed structural designs, reasonable extension of time will be granted on application, but no claim for monetary compensation will be entertained
Tenders containing extraneous conditions not covered by the tender call notice are liable for rejection
The contractor shall furnish a certificate that he is not related to any officer of P.W.D./R.W.D. of the ranks of Assistant Engineer and above and any officer of the rank of Assistant Secretary and above of the Works Department / R.D. Deptt.
All tenders received will remain valid for a period of 90 days from the date of receipt of tenders
The contractor shall abide by the fair wages clause of the contract together with latest revised labor rates and statutory increases
The contractor will not claim anything if the work is curtailed or stopped at any stage for want of funds or other reasons
If the tenderer backs out before acceptance of the tender, penal implication for forfeiture of E.M.D. will be levied
Compensation for delay: 0.5% on the estimated cost for every day the work remains un-commenced or unfinished after proper dates, not exceeding 10% of the estimated cost
For failure to complete one-fourth, one-half, or three-fourths of the work within the respective timeframes, compensation of one-third percent on the estimated cost for everyday the due quantity remains incomplete, not exceeding 10% of the estimated cost
The contractor is liable for damage done and for imperfections for 24 months after the final certificate of completion
The contract shall not be assigned or sublet without the written approval of the Executive Engineer
All sums payable by way of compensation shall be considered as reasonable compensation to be applied to the use of Government without reference to the actual loss or damaged sustained
The date of issue of the notice to the contractor to attend Division office for signing the agreement shall be treated as the date of commencement of work
The tenderers are required to pay royalties of all materials as per the rate prescribed by State Govt. from time to time and produce receipts
All stock and store materials like cement, steel, Maxphalt paints etc., are to be arranged and supplied by the contractor himself as per I.S. specification
No monetary claim or compensation will be entertained for delay in supply of materials by the department
Payment will be made on receipt of bills in complete shape by the authority subject to availability of funds (Letter of Credit)
The department is not liable for payment of any compensation for delay in payment of running/final bill
The agreement will stand cancelled on the last day of the financial year; no extension of time will be granted beyond this date
Recoveries will be made based on EMF, DMF, and Additional Cost as applicable from the bills of the contractor as per letter No.223 dated 23.03.2023 of the Collector, Rayagada

To avail EMD exemption, the intending Engineering Contractor must declare that he has not availed such exemption for more than two works during the current financial year
Additional Performance Security will be deposited by the successful bidder if the bid amount is less than the estimated cost put to tender, ranging from 0.2% to 0.5% increment for every percentage below 10%
Failure to deposit the additional initial security amount or sign the contract within the stipulated time will lead to forfeiture of EMD and withdrawal of tender acceptance
The initial security deposit should be in shape of pledged NSC/POTD/POSB/KVP/Deposit receipt of Scheduled Bank
Security deposit by way of deduction from bills will be 5% of the gross amount for B class & above contractors, and 3% for C & D class contractors
The tenderer whose tender is selected for acceptance shall within 7 days make an initial security deposit of 2% of the tendered amount and sign the agreement in P.W.D. form No. P1
The security deposit, together with the earnest money and the amount withheld, shall be retained as security deposit for the due fulfillment of the contract
Additional performance security shall be deposited by the successful bidder when the bid amount is seriously unbalanced in shape of Post Office Saving Bank Account/National Saving Certificate/Postal Time deposit Account/Kissan Vikash Patra/Deposit Receipt of scheduled Bank
Security deposit of the contractor shall be refunded only 12 calendar months after the date of completion of the work, provided the final bill has been paid and defects rectified
In case of tender by partners, any change in the constitution of the firm shall be forthwith notified to the Engineer-in-charge; failure to notify within 15 days may lead to rescission of contract and forfeiture of security deposit
GST will be deducted/added as per applicable law time to time
