APS can be in the form of Insurance Surety Bond, Account Payee Demand Draft, Fixed Deposit Receipt, Bank Guarantee (including e-Bank Guarantee) from any Scheduled Commercial Bank or Online Payment.
Failure to submit APS, Performance Security, and sign the agreement within the prescribed time will lead to cancellation of LoA and other actions.
EMD of unsuccessful bidders (except the 2nd lowest) will be refunded within 30 days after opening of Financial Bids upon written request.
8% of each bill amount will be withheld as performance security.
The Bank Guarantee for Performance Security must remain valid till one month after expiry of the defect liability period.
The Bank Guarantee for APS must remain valid till one month after expiry of the duration for completion of the work.
BMC may rescind the contract for various reasons, including failure to rectify defective work, suspension of progress, or failure to comply with DTCN provisions, leading to forfeiture of EMD/ISD and a 20% penalty on the value of left-over work.
