The successful Tenderer must execute an agreement in P.W.D. P-2 Contract form within 7 days after receipt of Letter of Intimation.
The contractor is responsible for payment of all royalties and local taxes.
No materials will be supplied from the Corporation Store unless under special circumstances.
The contractor is fully liable to indemnify the Corporation for any compensation under the Workmen’s Compensation Act.
The contractor is responsible for proper storage of materials; no cost for sheds or watchmen will be borne by the Department.
Jurisdiction for disputes is Bhubaneswar, Odisha.
The contractor must arrange water supply and sanitary arrangements for labour camps at his own cost.
No part of the contract shall be sublet without written permission of the Executive Engineer.
The contractor must inspect the site, quarries, factories, and company sale centers before quoting rates.

SC/ST Category Contractors seeking EMD exemption or Price preference must produce an affidavit to this effect.
SC/ST Contractors with Degree/Diploma in Engineering are not allowed to avail both EMD exemption and price preference.
Additional Performance Security (APS) is required on an incremental basis where the accepted bid price is lower than the Cost Put to Tender, except for Turnkey Tenders.
APS is calculated based on the Rounding Off of Percentage Less (ROPL) of accepted Bid Price compared to the Cost Put to Tender.
No APS is required if ROPL is up to (-)10%.
If ROPL is below (-)10% but not below (-)20%, APS is incremented by 0.2% for every percentage of ROPL below (-)10%.
If ROPL is below (-)20% but not below (-)30%, APS is incremented by 0.3% for every percentage of ROPL below (-)20% in addition to 2% of the accepted bid price.

Additional Performance Security must be submitted in shape of NSC/Post Office Savings Bank Account/Post Office Time Deposit Account/Kishan Vikas Patra/Bank Guarantee of scheduled bank, pledged in favour of Executive Engineer Lift Irrigation Division Bhubaneswar, within 7 working days of Letter of Acceptance (LOA).
Initial Security Deposit (ISD) equal to 2% of the order value (including EMD) must be furnished within 7 working days of LOA.
The security deposit shall be released after completion of a guarantee period of 24 months from the date of handing over the Package.
EMD will be forfeited if the successful bidder fails to execute the agreement or furnish required performance/additional performance security within the specified time.
EMD will be forfeited if any uploaded documents are found false/fabricated/bogus, leading to blacklisting.
Labour Cess @1% of the gross amount of the contractor bill will be deducted.
No Tenderer is allowed to back out from the process; EMD may be forfeited, and other actions taken.
