All tenders received will remain valid for 180 days from the date of opening of Financial Bids.
The contractor must submit a work plan at the time of agreement execution.
No claim of idle labour/machinery/equipment will be entertained.
The date of commencement of work shall be notified in the work order.
The contract work should not be sublet; otherwise, the contract may be rescinded.
The authority reserves the right to increase or decrease the quantity of work items, which will not invalidate contract rates, but no compensation will be provided except for extension of time.
The work may be split and distributed among several contractors without compensation to the original contractor.
The contract is deemed to have been entered into within the State of Odisha for jurisdiction purposes.
Contractors must produce a valid labor license before signing the agreement or within 7 days of the work order.
The contractor is liable to indemnify the Department for any compensation under the Workmen's Compensation Act.
Contractors must abide by fair wages clauses and not pay less than the fair wages fixed by the Government.
No compensation will be paid for damage due to natural calamities.
No claim for extra items or extra quantity will be entertained unless a written order is obtained and rates settled before execution.
The contractor must abide by the C.P.W.D safety code rules.
The contractor is responsible for all incidentals, sundries, and contingencies, including rent, royalties, taxes (except GST), tolls, conveyance, temporary structures, labor camps, water supply, safety equipment, fencing, and medical aid.
Deduction of income tax at source and surcharge will be made from each running account bill.
Royalties for materials utilized will be recovered from the bill based on Government-fixed rates.
The Corporation does not accept responsibility for the correctness and completeness of the schedule of quantity, which is subject to alteration without invalidating the contract or providing extra monetary compensation.
Samples of materials (stone, metal, chips, sand, cement, mechanical, electro-mechanical, electrical) must be deposited for testing and acceptance, with transportation and testing charges borne by the contractor.
Items not covered by the tender notice will be paid at current State schedule rates, or based on approved analysis for items not in the schedule.
All preliminary works (GSTs, mixing platforms) are to be done at the contractor's cost.
After work completion, all surplus materials and debris must be removed, and the site cleaned.
The contractor must supply necessary labor and materials for alignment, level recording, and tools/plants at their own cost.
No interest is chargeable for dues or additional dues.
The contractor is responsible for protecting men, machinery, materials, and work in progress against damages.
Adequate protection measures for completed works or works in progress must be provided until completion and handing over.
Dewatering from foundations is at the contractor's cost.
Quantities for items with quoted rates more than 25% of estimated rates cannot be varied by more than 5% without competent authority approval.
In case of discrepancy in DTCN, conditions in F2 form shall prevail.
Payment will be made after successful completion of work, testing, commissioning, and handing over to the concerned Pani Panchayat.
The tenderer must sign each page of the tender paper; otherwise, it will be rejected.
Damages to Government or private property during pipeline work must be compensated by the contractor.
If the contractor quotes abnormally low rates for some items, the Corporation may withhold the differential cost between such low rates and schedule rates from payments until those items are completed.
Payment will be made after completion of work, handing over of electric line and substation to TPNODL, and completion of all formalities with TPNODL.

Security & deductions from the DTCN (17)

SC/ST Category Contractors seeking EMD exemption or Price preference must furnish an affidavit and have a Registration certificate up to "B" Class.
SC/ST Contractors with Degree/Diploma in Engineering are not allowed to avail both EMD exemption and price preference.
Contractors should not have been awarded more than 2 or 3 works during the current financial year to avail EMD exemption.
EMD for each package varies from Rs. 12,061 to Rs. 55,942.
Additional Performance Security (APS) will be obtained from the selected bidder on an incremental basis if the accepted bid price is lower than the Cost Put to Tender, except for Turnkey Tenders.
APS is not required if the accepted bid price is up to (-)10% less than the Cost Put to Tender.
If ROPL is below (-)10% but not below (-)20%, APS is 0.2% for every percentage of ROPL below (-)10%.
If ROPL is below (-)20% but not below (-)30%, APS is 0.3% for every percentage of ROPL below (-)20% plus 2% of the accepted bid price.
If ROPL is below (-)30% or more, APS is 0.5% for every percentage of ROPL below (-)30% plus 5% of the accepted bid price.
APS shall be treated as part of the performance security and refunded immediately on successful completion of work within 7 days of completion certificate issuance.
Initial Security Deposit (ISD) of 2% of the order value (including EMD) must be furnished within 7 working days of Letter of Acceptance (LOA).
The security deposit shall be released after a guarantee period of 24 months from the date of handing over the Package.
EMD will be forfeited if the successful bidder fails to execute the agreement or furnish required Performance Security/Additional Performance Security within the specified time.
EMD will be forfeited if any uploaded documents are found false/fabricated/bogus, leading to blacklisting.
Labour Cess @1% of the gross amount of the contractor bill will be deducted.
Security deposit @ 5% of the bill will be deducted and refunded after 24 months from the date of handing over, subject to final bill payment.
Any defect within 24 months of commissioning must be rectified by the contractor within 7 days; failure to do so may result in the work being done by another agency, with costs deducted from the contractor's security deposit.
