SC/ST Category Contractors seeking EMD exemption or price preference must furnish an affidavit to that effect.
SC/ST Contractors with Degree/Diploma in Engineering are not allowed to avail both EMD exemption and price preference.
Additional Performance Security (APS) is required for accepted bid prices lower than the Cost Put to Tender, calculated incrementally based on the Rounding Off of Percentage Less (ROPL) of the accepted bid price, except for Turnkey Tenders.
APS is not required if ROPL is up to (-)10%.
If ROPL is below (-)10% but not below (-)20%, APS is 0.2% for every percentage of ROPL below (-)10%.
If ROPL is below (-)20% but not below (-)30%, APS is 0.3% for every percentage of ROPL below (-)20% plus 2% of the accepted bid price.
If ROPL is below (-)30% or more, APS is 0.5% for every percentage of ROPL below (-)30% plus 5% of the accepted bid price.
Additional Performance Security shall be refunded immediately on successful completion of the work within 7 days of issuance of Completion Certificate/Provisional Completion Certificate.
Additional Performance Security must be submitted within 7 working days of Letter of Acceptance (LOA) in the form of NSC/Post Office Savings Bank Account/Post Office Time Deposit Account/Kishan Vikas Patra/Bank Guarantee.
Initial Security Deposit (ISD) of 2% of the order value (including EMD) must be furnished within 7 working days of LOA in the form of NSC/Post Office Savings Bank Account/Post Office Time Deposit Account/Kishan Vikas Patra/Deposit Receipt (TDR).
The security deposit shall be released after a guarantee period of 24 months from the date of handing over the Package.
EMD will be forfeited if the successful bidder fails to execute the agreement or furnish required performance/additional performance security within the specified time.
EMD will be forfeited if any uploaded statement, document, or certificate is found false/fabricated/bogus, leading to blacklisting.
If compensation exceeds 10% or the whole security deposit, the Executive Engineer may rescind the contract, with 20% of the left-over work value realized as penalty.
Security deposit @ 5% of the bill will be deducted and refunded after 24 months from the date of handing over, subject to final bill payment.
Failure to rectify defects within 7 days may result in the Department engaging another contractor, with costs deducted from the security deposit.
